Our Terms & Conditions
PRE-TRAVEL CONSUMER DISCLOSURE NOTICE
We’re excited to work with you on your travel plans! In this agreement, we’ll describe what we’ll do for you – and, we’ll explain your responsibilities as clients. ("We," "us," and "our" will refer to Romantics Travel while "you" and "your" will refer to you of course as well as all others on whose behalf you’re acting [and for whom you’re confirming that you have the authority to bind the others to the terms of this agreement].
1. OUR SERVICES
As your romance travel professionals, we will do the following for you:
Consult with you about your trip – asking lots of questions about where you want to go (and when), what you want to do, how much you want to spend, and other factors
Research and offer you a variety of options that fit your travel wishes and budget
Book on your behalf the trip components and confirm the arrangements with you
Answer your questions about the trip and help you communicate with the suppliers operating your trip if problems arise
You acknowledge that our role will be that of advisors and consultants. You will make the final decisions about your travel dates, trip components, and payments.
You will be responsible for confirming that the details shown on your travel documents are correct and for alerting us immediately if you find errors or discrepancies.
2. OUR FEES
To perform the professional services required to plan and manage your trip, we charge a NON-REFUNDABLE service fee determined at the time of trip planning. (the “Service Fee”). The Service Fee is due at the time you sign this agreement so that we may research your trip and give you proposed itinerary information. We invest a lot of time, effort, and expertise into planning your trip, so if you decide ultimately to book your trip without us or you choose not to go, you agree that we will retain the Service Fee as liquidated damages on account of our losses in order to compensate us for the efforts we have made on your behalf. You acknowledge that the Service Fee will NOT be applied as a credit toward your trip payments.
All payments must be made by credit card. We require a credit card authorization form signed by you and each guest that pays us directly showing the account number, the amount to be charged, the full name as it appears on the card, the billing address, and the expiration date.
3. TRIP PAYMENTS AND CANCELLATIONS
Once you have made final decisions about your travel plans and submitted any required deposits, we will begin booking the components for your trip. You are solely responsible for making all required payments for your trip on time and in full. If you do not make the required deposit, we will not make any reservations. If you do not make the remaining payments (including final payment) on time, your travel arrangements will be canceled, you will forfeit any payments made earlier, and you will be denied access to the booked travel services, subject to the application of any laws in the jurisdiction cited below in this agreement. In such an event, we will not be responsible in any way for lost deposits, incurred expenses or fees, or other lost monies.
Suppliers may impose supplemental price increases after we book your travel plans (e.g., additional governmental taxes and fees, fuel surcharges, currency market fluctuations). We will notify you if this happens, once the suppliers have contacted us, and you will be responsible for paying these post-booking price changes (which will be added to the final payment due), subject once again to any applicable local laws.
If you wish to cancel your trip, you must notify us in writing. If we do not receive this written notice and any applicable cancellation penalties are not paid, the trip will not be considered canceled and may be subject to additional penalties until all required paperwork is received in its entirety. The suppliers involved with your trip may have additional terms and conditions that may apply to your cancellation.
We reserve the right to make substitutions or modifications to the carriers, hotels, departure dates, return dates, departure cities, or destinations if necessary due to reasons beyond our control. In these situations, we will notify you as soon as possible, and we will work with the travel suppliers involved in your trip to substitute comparable or better services, with the express understanding from you that our efforts on your behalf will waive any additional remedies.
4. YOUR RESPONSIBILITIES
Age: You agree that you are old enough to use the booked travel services.
Health and Other Hazards: You agree that it is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. We assume no responsibility for and shall not be liable for unsafe conditions or health hazards including pandemics or other illnesses. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country.
Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier requirements, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.
Financial Condition of Travel Suppliers: We are not responsible for the acts or omissions of travel suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the suppliers, and we have no liability for recommending a trip credit in lieu of a refund.
Rebooking: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, and may charge a nonrefundable fee for such services.
Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.
RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN PARAGRAPHS 1-3 ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in [county name, state name] will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
Travel Documents: You agree to be fully responsible for reviewing your travel documents and confirming that the details are correct and for alerting us immediately if you find errors or discrepancies.
International Travel: You agree to be fully responsible for complying with any passport, visa, and immigration requirements that apply to your travel plans. For all international destinations, a U.S passport is required for U.S. citizens, and many countries require that your passport be valid for at least six months after you return home. You should confirm any visa requirements with the relevant government sources (e.g., embassies or consulates; travel.state.gov for U.S. citizens. We accept no responsibility if you are unable to travel due to failing to comply with these requirements. Also, we recommend that you review any governmental alerts, advisories, warnings, and prohibitions that apply to your destinations; by offering travel to a destination, we do not represent or guarantee that travel to that place is safe or without risk. If your chosen itinerary requires specific immunizations, it is your responsibility to arrange those vaccinations for your trip. As you are aware, living standards and practices at your destination and the standards and conditions there with respect to the provision of utilities, services, and accommodations may differ from those found at home.
Your Change of Plans: You acknowledge that last-minute or unexpected changes can affect the quality of your ceremony or the entire trip, and you agree that we are not responsible if you are ultimately unhappy due to these changes. If you change plans and we cannot provide travel services in the end, then you agree to release us from all contract obligations and hold us in no way responsible for any nonperformance. Many suppliers such as airlines do not allow changes such as new or corrected names, and they may treat those requests as cancellations subject to their own policies. We are not responsible if you or your guests or companions cannot take the trip due to illness, hospitalization, accident, transportation problems, acts of God, or any other cause.
Flights: If you cannot take a flight as booked, you must contact us as soon as possible so that we may review your options. If you fail to check in on time for a confirmed flight reservation, or you fail to take flights in the order they are shown in your travel documents, the affected airline may list you as a "no show" and in turn you may be charged additional fees or your entire remaining air itinerary may be canceled. After you have begun your trip, it is your responsibility to confirm all onward flights and to check flight schedules (we recommend contacting airlines at least 72 hours before any scheduled departure during your trip).
Verbal Abuse and Harrasment: You recognize the right of employees, suppliers and agents of Romantics Travel to work in an environment free from verbal abuse and harassment and undertake to take all reasonable and appropriate actions to foster such an environment. Verbal abuse and harassment includes, but is not limited to, threats or a pattern of aggression, insulting or demeaning behavior by you or any member of your group, where the person knows or reasonably ought to know that the behavior is likely to create an intimidating or hostile environment.
